BRiMM Membership Terms & Conditions

  1. The BRiMM Membership (“membership”) is operated by BRiMM Ltd, company number 16327149, with its registered office at International House, 64 Nile Street, London, England, N1 7SR (“we”, “us”, “our”).
  2. The BRiMM Membership is a scheme allowing any individual who has signed up, in their personal capacity, to become a member to access certain benefits across the BRiMM Website in exchange for the membership fee.
  3. Customers must be 18 or over to sign up as a BRiMM member.
  4. Until communicated otherwise, BRiMM operates only in the UK, and only ships to UK addresses. Customers without a UK delivery address are welcome to join as members but will not be able to make full use of their membership.
  5. You can sign up to BRiMM membership online at www.wearebrimm.com (the “Website”).
  6. By signing up to BRiMM membership, you agree to be deemed to have accepted these terms and conditions, so we recommend that you read them carefully.
  7. BRiMM membership is subject to you agreeing to, and complying with these terms and conditions of membership

A. Becoming a BRiMM Member

  1. Your Membership will commence, and a contract is formed on receipt of successful payment by us from you.
  2. To become a Member, you must create an account on our Website and insert your details including your full name, email address and payment information.
  3. An individual email address is needed to join BRiMM Membership. The same email address cannot be used for more than one Membership and individuals cannot have multiple Memberships.
  4. On purchase of a Membership, the membership fee will be charged on a rolling basis unless cancelled in accordance with the membership subscription package you have purchased.
  5. If you have purchased a Founder Membership, this is a one-time fee and will not be charged on a recurring basis.
  6. If you are outside the UK, the rolling Membership fee will be converted into your local currency at the point at which we take your payment and will therefore be subject to the exchange rate on the day of such payment.

B. Membership benefits

  1. By signing up to BRiMM membership, you will receive (i) Membership prices on each of our Reset box products (”Reset boxes” includes all of our curated collections of products with “Reset box” in the product name. Membership pricing is advertised on the Website and is only applied to the products that display Membership pricing); (ii) 10% cash back of product prices of any other products purchased on the Website that do not already have membership pricing and applied to future purchases (”Members Cashback”); (iii) access to member only content and (iv) priority access to events.

C. Members Cashback

  1. Members Cashback will be calculated based on 10% of the product prices in your order
  2. Members Cashback will be visible after purchase and can be viewed in your Member Account
  3. Members Cashback can be redeemed online at the Website, on any in-stock products (excluding Reset boxes)
  4. To redeem your Members Cashback on the Website, enter your unique Members Cashback code at checkout.
  5. Members Cashback can only be redeemed by the named account holder.
  6. Members Cashback can be redeemed in multiple transactions. The value of your Members Cashback will reduce as you spend it.
  7. Members Cashback is not redeemable for cash.
  8. Members Cashback cannot be redeemed against delivery charges, gift cards, tickets to events, membership fees or services.
  9. Please refer to the Site Terms of Service on this page which govern the purchase of products from the Website.
  10. Any unused Members Cashback will expire once a Membership is cancelled.
  11. If you return all or part of an order or purchase made with Members Cashback, or if we have been unable to fulfil part of your order, that was purchased in whole or in part with Members Cashback, your refund will be only for your payment, with Members Cashback being returned to your Member Account. Please note that the proportions of your refund that you receive as a gift card and to your original payment method may vary.
  12. All refunds will be subject to the BRiMM Return & Refund Policy.
  13. Where you make a purchase using solely your Members Cashback, you will not be entitled to a cash refund in any circumstances.

D. Membership Fees — Payment

  1. For Membership, customers can choose to pay a monthly or annually subscription.
  2. An initial payment will be taken on the date of sign up. For monthly membership: payment will be taken on or before that same date each month. For annual membership: payment will be taken on or before that same date the 12 months later.
  3. When you give your credit or debit card details you are confirming that you are either the card holder, or that you have permission from the card holder to use the card for the purpose of signing up to BRiMM Membership. You agree and acknowledge that your membership has an initial and recurring payment charge at the then-current subscription rate and you accept responsibility for all recurring charges prior to cancellation, including where applicable any charges processed by us after the expiration date of your payment card.
  4. No payment will be taken from your card until your monthly payment is due.
  5. Your membership payment will be handled by a third party. Please note, when you place an order for BRiMM membership, the third party will securely store your card details so for us to take your monthly payment.
  6. You should be aware that where you have not paid us for your monthly subscription by the due date (“Unpaid Amounts”), and you still do not make payment within one month of the due date we will automatically cancel your membership. If your membership is cancelled, you may be able to re-subscribe in the next sign-up window. Due to the limited number of memberships, we may not be able to guarantee that a membership space will be available.
  7. If you think that an invoice or any amount charged to you is wrong, please contact us at hello@wearebrimm.com promptly to let us know. Please note that any such cancellation by us, or any other failure or delays to exercise our rights or remedies under these terms or at law in respect of your non-payment, shall not constitute our waiver of our rights or remedies and shall not prevent nor restrict the further exercise of that right or any other right or remedy by us.

E. Cancellation — BRiMM Membership

  1. You may cancel your BRiMM membership at any time.
  2. To cancel your BRiMM membership, please do so via your account at least 72 hours before your next billing date.
  3. The cancellation will come into effect at the end of that current billing month.
  4. This paragraph does not affect your statutory rights as a consumer, including, where applicable, your right to cancel your subscription in accordance with your statutory rights. To exercise your statutory rights, please contact Customer Services at hello@wearebrimm.com .
  5. We reserve the right to amend the BRiMM Membership or its terms (including the price of the membership) at any time. We will provide you with reasonable notice of any changes to these terms. You may cancel your subscription in accordance with this paragraph if you do not wish to proceed with any changes. If you continue to use your BRiMM Membership account, you will be deemed to have accepted any changes.

F. Pre-Orders

When you purchase a pre-order, you are buying an out-of-stock or soon-to-be-available product not yet in inventory. We may collect a payment at checkout, store your payment method, then fulfil and charge the full or remaining payment at a future date as advertised.

You can cancel a paid pre-order order that has not yet been fulfilled. If the order has been fulfilled, then you can't cancel the order, but you can request a full or partial refund. See our returns policy for more details on returns and refunds.

G. Data Protection

  1. We are the data controller of any personal information that we collect from you in order to administer BRiMM Membership. We take the protection of your personal information seriously. You can find out more about how we process your information by viewing our Privacy Policy here.
  2. Where you have consented for us to do so, we will send you the latest news from BRiMM, including newsletters, product launches, special offers and information about our planet fund. You can manage your preferences, or unsubscribe, at any time by logging on to your BRiMM account on the Website.
  3. You may receive emails or other communications from us from time to time which relate to your BRiMM Membership. If you no longer wish to be a BRiMM member, you can cancel your subscription in accordance with paragraph E.

  2. If your contact details change during the term of your subscription, you can update this via your account and it will take effect immediately. You will be responsible for providing valid contact details and for ensuring your contact details are up to date. If your contact details are not up to date then we shall not be responsible in the event that you fail to receive information or Members benefits including Members Cashback.

I. General Information

  1. If there is any reason to believe that you are not complying with these terms, we reserve the right to cancel your BRiMM Membership account.
  2. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process. We will not be held responsible for any delay or failure to perform or comply with our obligations under these terms if the delay or failure arises from any cause which is beyond our reasonable control.
  3. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  4. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to the products you purchase from us.
  5. These terms and conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts.

B. Membership benefits

By signing up to BRiMM Membership, you will receive:

  1. Members prices (”Members Prices”) on selected products, including ”Reset boxes” - our curated collections of products with “Reset box” in the product name. Members pricing is advertised on the Website and is only applied to the products that display Members pricing

  2. 10% cash back of product prices of any other products purchased on the Website that do not already have membership pricing and applied to future purchases (”Members Cashback”)

  3. Access to members-only online content

  4. Priority access to events.

C. Members Prices

  1. Members Prices will only be available for purchase if you add a Membership to the cart, or to existing signed in Members
  2. Members Prices will be advertised on site showing a discounted price compared to the normal full selling price for a product
  3. When a product with a Members Price is added to cart and checkout, the full normal price of the product will be displayed, with a product discount applied to the full price to reach the Members Price
  4. If a Membership is not yet purchased and removed from cart, the product price will revert to the full normal price

D. Members Cashback

  1. Members Cashback will be calculated based on 10% of the product prices in your order
